Romney pressed on abortion question

DEFIANCE, Ohio (AP) ? Republican Mitt Romney is renewing his focus on the nation's economy while facing continued pressure to break his silence on a GOP Senate candidate's statement that any pregnancy resulting from rape is "something God intended."

As Election Day looms less than two weeks away, the Republican presidential contender is also trying to move past new questions about his role in a key supporter's divorce. Court documents released Thursday reveal that Romney created a special class of company stock for Staples founder Tom Stemberg's then-wife as a "favor."

Romney has so far ignored the criticism and is instead accusing President Barack Obama of playing partisan politics in an "incredibly shrinking campaign."

"This campaign is growing. The momentum is building. We're taking back America," Romney told 12,000 supporters in Ohio late Thursday, the same night that media trackers confirmed the Republican's campaign was expanding its television advertising into Minnesota.

The economy was to play prominently in the presidential contest Friday.

As Obama takes a break from the campaign trail, Romney was to deliver what his campaign billed as a significant economic address in swing state Iowa. While he was not expected to break new ground, his campaign said Romney would use the speech to help crystalize the differences between each candidate's economic approach on the same day the government issues its final report on GDP growth before the Nov. 6 election.

The report ? set for release at 8:30 a.m. ? was expected to show that growth picked up only slightly in the third quarter. Tepid growth has given Romney an opening to challenge Obama's assessment that the economy is moving in the right direction.

Obama arrived back in Washington late Thursday following a 40-hour battleground state blitz that took him to eight states. He was taking a brief break from the campaign trail Friday and planned to spend much of the day at the White House.

But the Democratic campaign wasn't ceding the spotlight to Romney. Obama had a series of interviews scheduled, including several with local television stations in swing states. And the campaign announced Friday that the president will travel next week to Colorado, Wisconsin and Ohio for a series of campaign rallies and events.

The president was also using a trio of national interviews to reach key constituencies, including an MTV interview aimed at rallying the youth vote and a sit-down with American Urban Radio Networks, which has a largely black audience.

The president was also scheduled to talk with Michael Smerconish, the conservative-leaning radio host who backed Obama in the 2008 election.

On Thursday, the president made repeated, though indirect, references to Indiana Republican Richard Mourdock's controversial comment on rape and pregnancy.

"We've seen again this week, I don't think any male politicians should be making health care decisions for women," Obama told a crowd of about 15,000 in Richmond, Va. The president's aides pressed further, using a web video to highlight Romney's endorsement of Mourdock and to accuse the GOP nominee of kowtowing to his party's extreme elements.

Romney, who appears in a television advertisement declaring his support for Mourdock, ignored repeated questions on the matter. He centered his efforts instead on turning his campaign's claims of momentum into a more practical ? and ultimately necessary ? road map to winning the required 270 Electoral College votes.

Ohio, where he spent all of Thursday and will return Friday evening following the Iowa speech, is crucial to that effort. And Romney is trying to expand his path to victory.

Republicans and Democrats who track campaign spending confirmed that Romney will begin running television ads in Minnesota over the weekend.

The investment is described as a small buy that Democrats suggest is simply intended to generate media coverage and force Obama's campaign to invest there as well. Former President Richard Nixon was the last Republican to carry the state, in 1972.

"You're seeing a campaign which is an incredibly shrinking campaign right before your very eyes," Romney said of Obama in Defiance. "This is a time when America faces big challenges. We have a big election, and we want a president who will actually bring big changes."

Romney has disavowed Mourdock's comments, but his campaign says he continues to support the Indiana Republican's Senate candidacy.

At the same time, previously sealed testimony related to the Staples founder Stemberg's divorce was released Thursday in which Romney says he was initially skeptical of the idea for Staples, the office supply chain he now lauds as a business success story that he helped create.

The testimony had been sealed for almost two decades after Maureen Sullivan Stemberg sought unsuccessfully to alter the divorce agreement that provided her with 500,000 shares of Staples stock. Romney acknowledged in testimony that he and other Staples directors created a special class of company stock for Stemberg's then-wife as a favor to Stemberg, who is now a major political supporter.

At the time, Romney insisted the board's decision was made "in the best interests of the company's shareholders." His campaign did not address the issue directly when asked Thursday night, instead referring questions to attorney Robert Jones.

Jones rejected the notion that Romney undervalued Staples stock to help Stemberg.

English Catholic Church asks Vatican to posthumously remove Jimmy Savile's papal knighthood

LONDON - The Catholic Church of England said Saturday it has contacted the Holy See to ask if the papal knighthood awarded to late television star Jimmy Savile could be posthumously removed following sexual abuse allegations.

The head of the church, the Archbishop of Westminster Vincent Nichol, wrote to Vatican officials last week with the request in recognition of the "deep distress" of the victims allegedly abused by Savile, a well-known BBC children's television host who died last year at age 84.

Police believe Savile to be one of the most prolific sex offenders in recent history, with a "staggering number" of people reporting abuses by him after his death.

Some 300 potential victims have come forward with abuse allegations, police said. Most of them say they were abused by Savile, but some say they were abused by other people, Metropolitan Police said Friday.

Savile was made a Knight Commander of St Gregory the Great by Pope John Paul II in 1990 for his charity work.

He was also knighted by Queen Elizabeth II for his services to charity and entertainment.

Black widow's tango mortale in gamma-ray light: Scientists discover record-breaking millisecond pulsar with new analysis method

ScienceDaily (Oct. 24, 2012) ? Pulsars are the compact remnants from explosions of massive stars. Some of them spin around their own axis hundreds of times per second, emitting beams of radiation into space. Until now, they could only be found through their pulsed radio emissions. Now, scientists at the Max Planck Institute for Gravitational Physics (Albert Einstein Institute/AEI) in Hanover assisted by the Max Planck Institute for Radio Astronomy have discovered a millisecond pulsar solely via its pulsed gamma radiation. A new data analysis method developed by the AEI was crucial for the success. The pulsar is accompanied by an unusual sub-stellar partner, which it is vaporizing, hence the name "black widow."

Back in 1994, astronomers discovered a source of strong gamma-rays in the constellation of Centaurus. They suspected that a pulsar was the origin of the energetic radiation. Now, a team of scientists led by Holger Pletsch from the Max Planck Institute for Gravitational Physics (Albert Einstein Institute, AEI) has solved the mystery and identified the culprit: the millisecond gamma-ray pulsar PSR J1311-3430. The development of a new data analysis method by the AEI scientists enabled the discovery, since rapidly spinning pulsars are extremely difficult to find.

To unambiguously identify a gamma-ray pulsar, astronomers must know its properties to very high precision. This includes its position, spin frequency, and how the latter changes over time. If the pulsar is in a binary system, the analysis problem is even more complicated: at least three additional orbital parameters have to be determined as well.

In the case of PSR J1311-3430 astronomers had already observed the companion, which is heated by the radiation from the pulsar, with optical telescopes. They were thus able to partially constrain the orbital parameters and confine the position of the pulsar.

"We developed a particularly efficient method to search the data from NASA's Fermi satellite for gamma-ray millisecond pulsars, including those in binary systems. Only this method enabled us to probe the wide parameter ranges," says Holger Pletsch, lead author of the article published in Science. The new analysis method enables scientists to conduct a 'blind search' for gamma-ray millisecond pulsars for the first time -- right up to very high spinning frequencies.

The scientists analysed the Fermi data on the Atlas computer cluster at the AEI. "Our search used data collected by the gamma-ray satellite over a total of four years. Very soon after we started running the analysis, a clear signal showed up in the results. What we saw was very exciting," says Pletsch.

PSR J1311-3430 spins 390 times per second, emitting gamma-ray photons into space in the form of a beam, similar to a lighthouse. In roughly one in a million revolutions of the pulsar, a single photon reaches the detector on board Fermi.

The gamma-ray signal also reveals much about the companion to the astronomers: the orbital motion of the binary system modulates the photon arrival times, yielding information about the partner star. "The companion object is small and unusually dense," says AEI Director Bruce Allen. "It is at least eight times as massive as the planet Jupiter, but has at most 60 percent the planet's radius."

From this information, the researchers calculated the density of the companion, which turned out to be unusually high; it is around 30 times as dense as the Sun. Presumably, the small companion is the compact remnant of a star which has been orbiting the pulsar since earlier times. Over time, the pulsar accreted matter from the star, thereby accelerating its rotation. Pulsar and companion moved closer and closer together.

"At present, the remaining stellar core, which presumably consists mainly of helium, is heated by the radiation from the pulsar and literally evaporated," says Holger Pletsch. Astronomers call this type of pulsar a 'black widow', in analogy with a species of spider which kills the smaller male after mating. In the distant future, PSR J1311-4330 might possibly completely vaporize its companion and from then on travel through space alone.

And that's not all: "Our discovery is not only a first, it also sets several new records," explains Bruce Allen. Currently, the odd couple is orbiting its common centre of mass on an almost perfect circular trajectory in only 93 minutes. This is the shortest known orbital period of all pulsars in binary systems.

At a distance of only 1.4 Earth-Moon separations, the binary system is the closest one known to date with a pulsar. The pulsar is speeding along its circular orbit with at least 13,000 kilometres per hour. Its light-weight companion is even faster, at up to 2.8 million kilometres per hour.

Holger Pletsch and his colleagues also had a close look at older observations with the Green Bank radio telescope in West Virginia, but were unable to find the fast pulsar here. "Apparently, the cloud of vaporized material from the companion absorbs most of the radio wave emissions from the pulsar and possibly makes it invisible to radio telescopes," says Lucas Guillemot from the Max Planck Institute for Radio Astronomy in Bonn, co-author of the publication. The scientists are already planning further observations at higher radio frequencies. They hope to use them to accurately determine the object's distance from Earth, for example.

Systems like this provide astronomers with new insights into the evolution of very close binary systems, which are as yet still incompletely understood. PSR J1311-3430 could also shed new light on the generation of the gamma-ray photons and radio emissions in the strong magnetic field of pulsars. The pulsar may just be the tip of the iceberg: many other unidentified gamma-ray sources may harbour similarly unusual systems. Thirty years after the discovery of the first millisecond pulsar in the radio range, the novel analysis method of the Max Planck researchers at the AEI has opened a new door to the easier identification of these elusive celestial objects.

Call it the prosecutor's prerogative.?The Los Angeles City Attorney's Office has officially charged Bobby Brown with multiple DUI counts stemming from his arrest Wednesday for drunken driving.?

The 43-year-old New Jack Swinger was pulled over for driving erratically around 1 a.m. in Tarzana, Calif. Brown was driving without his court-mandated dashboard Breathalyzer, according to city attorney spokesman Frank Mateljan.?

According to the first count against him, Brown was driving under the influence with a prior conviction and refused to take a chemical test when he was collared.?

Bobby Brown's latest hit: Another DUI hit

The refusal allegation carries a mandatory, minimum two-day stay in the slammer, while driving with a prior conviction carries a four-day jail term.?

Not only that, but the R&B star also was driving on a restricted license and ignored a court order to only drive vehicles that have alcohol-monitoring ignition interlock devices, which requires him to take a breath test before he can start the engine.?

The second and third counts carry a maximum of six months each in the slammer and up to $5,000 in fines.

An attorney for the singer, who's out on $25,000 bail, was not available for comment.

Bobby Brown busted for drinking and driving

This is Brown's second DUI bust this year. He was popped back in March in the San Fernando Valley and ended up pleading no contest and receiving three years' probation, after which he completed a stint in rehab.?

Bobby Brown's not the only celeb in trouble with the law

An arraignment on the new DUI charges is scheduled for Nov. 16, and if a judge finds that the New Edition crooner violated his probation, he could receive six months in the pokey and a $610 fine for that as well.?

Of course, if Brown heads back to rehab, it's possible he could get a reprieve.?

(AP) ? The recent homicides of six people along the Tennessee-Alabama state line have brought back fear and bad memories of previous violent slayings near the quiet rural town of Fayetteville, Tenn.

Dozens of law enforcement personnel in Tennessee and Alabama have been working long hours over the past three days to identify a suspect in the deaths of three women and a toddler near Fayetteville and the deaths of two men in Alabama. The bodies of the women and child were found Monday. The bodies of the men were found the following day.

The killings come just three years after six people, including a family in Tennessee and a man in Alabama, were slain near the same border town.

For Lincoln County Sheriff Murray Blackwelder, this is his second multiple-homicide case in a six-year career. The recurrence so soon of such violence has taken a toll on everyone in the county, from police officers to the families who live there, he said.

"It shakes the community," he said. "It shakes it to its core and I understand people being nervous. I understand people being scared because of the unknown."

Authorities on Monday found the bodies of 22-year-old Chabreya Campbell, her 18-month-old son, Rico Ragland, and her friend, 21-year-old Amber McCaulley of Huntsville, Ala., in a home near Fayetteville. Campbell was six months pregnant. A 3-year-old boy was unharmed.

Hours later, police found 21-year-old Jessica Brown's body in a house elsewhere in the county. A 2-month-old infant in the house was not hurt.

Investigators started looking for 24-year-old Warren Vincent Crutcher as a person of interest in the case, but he was found dead Tuesday, his body dumped in some Alabama woods just across the state line. A sixth victim, identified as Jeffrey Pope, was found dead the same day in his Huntsville, Ala., home. The common thread in all three cases: Crutcher knew the other victims.

As investigators try to unravel the case, some in the community can't help but be reminded of the July 2009 killings. Like the events of that year, the latest crimes have left them in shock.

In the 2009 case, sheriff's deputies found 38-year-old Traci Shaffer, her son, Devin Brooks, and neighbor Robert Berber, both 16, dead in their home. The bodies of Traci Shaffer's brother, Chris Hall, 34, and father Billy Hall, 57, were found in a home across the road.

Jacob Shaffer and his unharmed 4-year-old daughter were found by authorities sitting on the porch of one of the homes where the bodies were found. Authorities then found 50-year-old Sidney Wade Dempsey beaten to death at a business in Huntsville, Ala., about 30 miles south.

Shaffer pleaded guilty to five counts of murder in the Tennessee slayings and was given five life sentences. He has not yet gone to trial in Dempsey's slaying.

Sheila Brannon, 50, has lived in Fayetteville her whole life and works just over the state line in Alabama at a fast food restaurant not far from where one of the bodies was found this week. Brannon said she immediately thought back to the Shaffer family.

"I never expected it to happen here again," she said, while standing outside the Fayetteville courthouse in the town's bustling downtown square.

She said the latest slayings have made her skittish and fearful, and she doesn't understand why anyone would kill a child.

"I thought it was sick. It's horrible," she said. "It's not like the baby could talk."

Blackwelder said there are similarities between this year's case and the 2009 killings.

While he said he couldn't go into detail, in both instances, family members and acquaintances were targeted, some children were killed while others were left unscathed, and the crime scenes were in both Tennessee and Alabama, miles apart.

Blackwelder said the intensity of the police work necessary to bring the Shaffer case to trial has been difficult on his deputies and staff.

"Unfortunately we have the distinction of having two multiple homicides and it takes a huge toll on the personnel," he said. "It takes a toll on their personal lives and it takes a toll on the resources that we have."

He said the investigators are working just as diligently as they did three years again to solve the latest killings. And he tried to assure residents that they shouldn't be afraid.

"I don't feel like the residents of Lincoln or Madison counties, either one, should be concerned with their safety, because this was not a random act," he said.

Business investment stalls as "fiscal cliff" looms

WASHINGTON (Reuters) - Business investment showed signs of stalling in September, an indication that worries over a possible sharp tightening in the federal budget are already weighing on the economy.

Other data on Thursday showed the number of Americans filing new claims for unemployment benefits fell last week, a fresh sign the labor market is slowly healing.

New orders for capital goods outside of defense and excluding aircraft -- a proxy for business spending plans -- was unchanged last month at $60.3 billion, Commerce Department data showed. Analysts polled by Reuters had expected a modest gain.

The reading highlighted concerns that companies are holding back investments due to fears the U.S. Congress could fail to avert sharp tax hikes and spending cuts in 2013, which threaten to send the country back into recession.

"The slowdown in business fixed investment during the second half of the year is even more pronounced than feared," said Harm Bandholz, an economist at UniCredit in New York.

Shipments of non-defense capital goods other than aircraft, which go into the government's estimates for economic growth, fell for the third straight month. As a result, JPMorgan lowered its estimate for third-quarter economic growth by two tenths of a point to a 1.6 percent annual rate.

The investment readings were part of a larger report that showed orders for long-lasting factory goods last month posted their biggest gain since January 2010. However, the rise was fueled by a spike in volatile aircraft orders and failed to make up ground lost in August.

Manufacturing has been a major driver of the recovery from America's 2007-09 recession, but now is beset by softer demand at home and abroad. The European debt crisis has suppressed orders at factories around the world, from China to the United States and Latin America.

ORDERS SOFT OUTSIDE OF TRANSPORTATION

The U.S. economy remains hobbled by a persistently high jobless rate. Incomes have stagnated and many families are awash in debts taken on during a housing bubble in the last decade.

Recently, however, the economy has shown a few positive signals, with the unemployment rate falling to 7.8 percent and retail sales picking up. Consumer spirits also have brightened.

Those signs of improvement appear to have done little to bolster President Barack Obama's bid for a second term, and there is only one more reading on U.S. unemployment before the November 6 election.

The Federal Reserve on Wednesday warned about the weakness in business investment, which has contrasted with brighter economic signals from household spending.

Even though businesses are ratcheting back spending plans, the factory sector still appears to be expanding slowly.

New orders for durable goods -- items like toasters and refrigerators that are meant to last three years or more -- rose a higher-than-expected 9.9 percent, partially reversing August's sharp loss.

Excluding transportation, orders rose a more modest 2 percent. Boeing received 143 orders in September, up from just one in August, according to information on the plane maker's website.

Separately, the Labor Department said initial claims for state unemployment benefits dropped 23,000 last week to a seasonally adjusted 369,000.

A Labor Department analyst said all states submitted data for the report and that there was nothing unusual in the raw data. The analyst said the data showed no signs of the factors that had appeared to generate sharp swings in the claims reading over the prior two weeks.

The four-week moving average for jobless claims, which smoothes out such volatility, rose 1,500 to a 368,000. Economists generally think a reading below 400,000 points to an increase in employment, with hiring likely outpacing layoffs.

The report gave investors a clearer picture that the labor market is slowly healing after the big fluctuations in the claims data earlier in the month.

U.S. stock prices rose, helped by a report that pointed to a pickup in Chinese factory output during the last three months of the year. Prices for U.S. government debt pared losses following the U.S. data.

A third report on Thursday showed contracts to buy previously owned U.S. homes rose far less than expected in September, although the data continued to point to an improving tone in the housing market.

The National Association of Realtors said its Pending Home Sales Index, based on contracts signed in September, gained 0.3 percent to 99.5.

2012 Antarctic ozone hole second smallest in 20 years

ScienceDaily (Oct. 24, 2012) ? The average area covered by the Antarctic ozone hole this year was the second smallest in the last 20 years, according to data from NASA and National Oceanic and Atmospheric Administration (NOAA) satellites. Scientists attribute the change to warmer temperatures in the Antarctic lower stratosphere.

The ozone hole reached its maximum size Sept. 22, covering 8.2 million square miles (21.2 million square kilometers), or the area of the United States, Canada and Mexico combined. The average size of the 2012 ozone hole was 6.9 million square miles (17.9 million square kilometers). The Sept. 6, 2000 ozone hole was the largest on record at 11.5 million square miles (29.9 million square kilometers).

"The ozone hole mainly is caused by chlorine from human-produced chemicals, and these chlorine levels are still sizable in the Antarctic stratosphere," said NASA atmospheric scientist Paul Newman of NASA's Goddard Space Flight Center in Greenbelt, Md. "Natural fluctuations in weather patterns resulted in warmer stratospheric temperatures this year. These temperatures led to a smaller ozone hole."

Observing Earth's Ozone Layer

Atmospheric ozone is no longer declining because concentrations of ozone-depleting chemicals stopped increasing and are now declining.

The ozone layer acts as Earth's natural shield against ultraviolet radiation, which can cause skin cancer. The ozone hole phenomenon began making a yearly appearance in the early 1980s. The Antarctic ozone layer likely will not return to its early 1980s state until about 2065, Newman said. The lengthy recovery is because of the long lifetimes of ozone-depleting substances in the atmosphere. Overall atmospheric ozone no longer is declining as concentrations of ozone-depleting substances decrease. The decrease is the result of an international agreement regulating the production of certain chemicals.

This year also marked a change in the concentration of ozone over the Antarctic. The minimum value of total ozone in the ozone hole was the second highest level in two decades. Total ozone, measured in Dobson units (DU) reached 124 DU on Oct. 1. NOAA ground-based measurements at the South Pole recorded 136 DU on Oct. 5. When the ozone hole is not present, total ozone typically ranges from 240-500 DU.

This is the first year growth of the ozone hole has been observed by an ozone-monitoring instrument on the Suomi National Polar-orbiting Partnership (NPP) satellite. The instrument, called the Ozone Mapping Profiler Suite (OMPS), is based on previous instruments, such as the Total Ozone Mapping Spectrometer (TOMS) and the Solar Backscatter Ultraviolet instrument (SBUV/2). OMPS continues a satellite record dating back to the early 1970s.

In addition to observing the annual formation and extent of the ozone hole, scientists hope OMPS will help them better understand ozone destruction in the middle and upper stratosphere with its Nadir Profiler. Ozone variations in the lower stratosphere will be measured with its Limb Profiler.

"OMPS Limb looks sideways, and it can measure ozone as a function of height," said Pawan K. Bhartia, a NASA atmospheric physicist and OMPS Limb instrument lead. "This OMPS instrument allows us to more closely see the vertical development of Antarctic ozone depletion in the lower stratosphere where the ozone hole occurs."

NASA and NOAA have been monitoring the ozone layer on the ground and with a variety of instruments on satellites and balloons since the 1970s. Long-term ozone monitoring instruments have included TOMS, SBUV/2, Stratospheric Aerosol and Gas Experiment series of instruments, the Microwave Limb Sounder, the Ozone Monitoring Instrument, and the OMPS instrument on Suomi NPP. Suomi NPP is a bridging mission leading to the next-generation polar-orbiting environmental satellites called the Joint Polar Satellite System, will extend ozone monitoring into the 2030s.

NASA and NOAA have a mandate under the Clean Air Act to monitor ozone-depleting gases and stratospheric depletion of ozone. NOAA complies with this mandate by monitoring ozone via ground and satellite measurements. The NOAA Earth System Research Laboratory in Boulder, Colo., performs the ground-based monitoring. The Climate Prediction Center performs the satellite monitoring.

Reducing Buildings' Greenhouse Emissions Will Require a Global ...

Real estate and construction companies around the world are taking more responsibility for the carbon footprints left by their buildings, and are even incorporating energy consumption into their strategies and risk assessments. But a recent survey of more than 400 businesses found many that still underestimate the value of energy efficiency and overestimate its costs.

?

Those are some of the key findings of a global survey of 423 senior executives from four sectors: residential real estate (which is the primary business of 37% of those polled), building construction (31%), commercial real estate (24%), and industrial real estate (9%). The respondents were evenly split among the United States, Europe, India, and China, and more than half generates annual revenues of $500 million or more.

?

The Economist Intelligence Unit conducted the survey on behalf of the Global Buildings Performance Network (GBPN), a partnership organization that disseminates knowledge about building energy efficiency and performance. Its findings were released last week.

?

Real estate development and construction account for anywhere from 30% to 40% of the world?s carbon emissions. GBPN advocates an 80% reduction in energy consumption from buildings by 2020. But that can happen, it says, only if real estate and construction companies, as well as lawmakers, are willing to take a ?deep path? that optimizes technologies and codes. ?Climate change targets will be nearly impossible to reach without industry?s full participation,? the survey?s authors state. ?The real estate and construction sectors can play a critical role in shaping energy.?

A?majority companies say they are already taking steps toward greater building efficiency. Nearly three fifths are replacing inefficient lighting, half are improving their HVAC systems, and more than one third are investing in ?smart? systems. Somewhat surprisingly, three-quarters of executives surveyed agree that energy -efficiency legislation in their countries benefits the buildings sector.

?

The survey?s authors found that 69% of the respondents? companies use energy efficiency as a risk management tool. More Europeans (38%) deliberately exceed government standards, compared with only 23% in other regions. Most companies?71%?are investing more in energy efficiency for new buildings rather than retrofits. Energy is also a major factor in investment decisions for 72% of those who rate their company as outperforming its competitors, compared with 56% of all other respondents.

However, the biggest obstacles to investing in energy efficiency include the lack of market demand for it (say 37% of respondents), the perception that energy efficiency doesn?t add value to a building (28%), and that there?s no compelling business reason to include it (25%). Indeed, only 31% of the executives polled say they audit their product?s energy use.

?

Insufficient government incentives, lack of government emphasis on energy-efficient policies, and the lack of regulatory enforcement were cited as policy barriers to energy efficiency in their buildings.

?

Energy efficiency and environmentalism are not as embedded in the business models of American companies as they seem to be in businesses in?other countries. Only 60% of real estate and construction businesses in the United States see reducing carbon emissions as being their responsibility, whereas at least 83% of executives polled in Europe, China, and India agree that business has an important role in that reduction.

?The U.S. is also an outlier with regard to taking responsibility for its vast emissions to date,? says the survey. ?Only 30% of [American] respondents believe that developed markets should contribute more to addressing climate change than the poorer developing economies. Respondents from Europe, India, and China are more evenly divided: 50-55% acknowledge that developed countries should contribute more.?

These responses seem to relate to?the relative cost of energy in the respondents? countries. Nearly two-fifths of executives in the U.S. identify ?cheap energy costs? as their biggest challenge to investing in energy efficiency, compared to the global average of 20%, and 13% among non-U.S. respondents.

There?s a disconnect as well between what some real estate and construction companies believe energy costs and what those costs actually are. Heating and cooling typically account for between 20% and 60% of total energy use in a building, depending on its efficiency. Yet one third of respondents thought heating and cooling cost less than 20%.

Two-thirds of respondents also assert that energy-efficient buildings cost 15% or more to build than a standard structure; 18% of the executives polled estimate the difference at more than 25%. The actual cost varies by building type, climate, and expertise, ?but should fall between 5% and 15%,? the survey?s authors state.

The survey concludes on a positive note, acknowledging that the real estate and construction sectors ?have come a long way in their approach to energy efficiency.? Yet both the private sector and policymakers ?can do much more.??

West U Receives No Input on Proposed Tax Rate, 2013 Budget ...

The West U City Council is expected to adopt its 2013 budget and city tax rate next week after receiving no input from its residents.

The council held two public hearings on Monday night for the proposed budget and proposed tax rate. No one commented at either public hearing. The council also held a tax rate public hearing on Oct. 8, but no one spoke at that meeting either.

The proposed budget accounts for $31.3 million in revenues and $34.3 million in expenditures.

The budget is expected to raise more total property taxes than last year?s budget by $559,522 or 3.68 percent. Of that amount, $118,057.90 is tax revenue to be raised from new property added to the tax roll this year.

Property taxes account for 51 percent of the city?s revenue, or $15.8 million.

The proposed general fund budget, which funds almost all city services, accounts for about $14.62 million in revenues and $15.34 million in expenditures. The city is using reserve funds to balance the budget, Finance Director Rhonda Daugherty said.

The largest portion of the general fund, or 65 percent, accounts for personnel and benefits.

The proposed budget accounts for a 1 percent structure adjustment and salary increase as of Jan. 1, 2013 and an average 2 percent pay-for-performance salary increase effective on staff?s anniversary dates. The budget also includes the annualization of the average 1.5 percent pay-for-performance on anniversary date plan that was approved in the 2012 budget.

The city council has set a not-to-exceed tax rate of $0.37411 per $100 valuation, which is the same tax rate as last year but it is higher than the effective tax rate.

The effective tax rate is the rate that would raise the same amount of revenue for the city as last year.

West U residents may pay more in property tax rates in 2013 even though the city?s tax rate may stay the same due to the increase in appraised property values.

If the city council approves the same tax rate as last year, the average resident with a home value of $753,383 per $100 valuation will pay an additional $7.08 per month.

South Africa police and protesters clash near mine shaft

JOHANNESBURG (Reuters) - South African police fired tear gas and rubber bullets at protesters hurling petrol bombs after a march on an Anglo American Platinum mine turned violent overnight, the latest sign of festering labor unrest.

Africa's top economy is under increasing pressure to mend industrial relations. Almost 100,000 workers, mostly in mining, have launched often illegal and violent strikes since August, eroding investor confidence and already shaky growth.

Truck drivers signed a wage deal on Friday ending a three-week strike that squeezed deliveries of fuel, cash and consumer goods. But that step forward was quickly overshadowed by a Standard & Poor's downgrade of South Africa's credit rating.

About 1,000 protesters gathered on Friday night in a shanty town near Rustenburg 120 km (70 miles) northwest of Johannesburg and marched toward Amplats' Khomanani 1 shaft, the South African Police Service said in a statement.

"Tear gas and rubber bullet rounds were used to disband the overzealous group," it said.

The crowd responded with petrol bombs, damaging one police vehicle, police said. There were no reports of injuries and four people were arrested.

Amplats, as the company is known, is the world's top producer of platinum. Striking leaders from Amplats and other mines met on Saturday to discuss strategy.

"All of the mines that you know are striking, their (strike) leaders are here," labor leader Evans Ramokga told Reuters. "Right now we are talking about the way forward... We are not afraid of dismissals."

Amplats, which has said it is losing an average of 3,800 ounces of production for each day of the strike, has fired 12,000 wildcat strikers. Other mining firms have followed suit.

More than 50 people have been killed in labor-related unrest in the last two months, including 34 shot dead by police at Lonmin's Marikana platinum mine on August 16 in the deadliest security incident since the end of apartheid.

Hundreds of miners marched on the headquarters of Impala Platinum in Johannesburg on Saturday to deliver a list of demands to the company.

"We are here, we are at Impala," Lesiba Seshoka, a spokesman for the National Union of Mineworkers (NUM), told Reuters by telephone as miners cheered and chanted in the background.

Seshoka put the number of marchers at 2,000, but the company said it was close to 400. A spokesman for Implats said the union's demands were not wage-related and had to do with other contract issues.

Kumba Iron Ore, one of the world's major producers of the steel-making ingredient, said on Friday it would seek criminal charges against illegal strikers who refuse to stop their occupation of its Sishen mine.

The strikers have seized about 3.3 billion rand ($380 million) worth of heavy equipment, including 88 haul trucks and 13 pieces of other equipment, including bulldozers.

The weeks of strikes have undermined confidence in South Africa's economy and the government of President Jacob Zuma, which critics say has been slow to respond.

Ratings agency Standard & Poor's cut South Africa's credit rating by one notch on Friday to BBB with a negative outlook, saying the strikes and social tensions could reduce fiscal flexibility and damage growth.

Police on Friday arrested two men for the killing of a NUM branch secretary, which NUM's spokesman has said was done in "execution style". Two workers at different shafts of Lonmin's Marikana mine were arrested, local police spokesman Thulani Ngubane said.

The six-week strike at Lonmin in August and September erupted out of a turf war between the NUM and the more militant Association of Mineworkers and Construction Union (AMCU), which accuses the NUM of selling out workers. ($1 = 8.6259 South African rand)

California's dueling tax hikes: 'Nightmare' ahead?

California Gov. Jerry Brown has asked voters to approve Proposition 30, a tax hike that he says will save the state from fiscal disaster. But another tax plan on the ballot could muddy the waters.

Gov. Jerry Brown's Proposition 30 intends to forestall "draconian" budget cuts by temporarily raising taxes, including sales taxes and income taxes on the wealthy. The initiative could largely determine his legacy, as well as the state?s fiscal health for at least a decade. Moreover, if successful, Prop. 30 could begin to shift the national conversation on taxes after decades of extreme antitax sentiment across the country.

Polls show that a thin majority of state voters support Prop. 30. But that support could be undercut by another proposition that aims to raise taxes for public education. Molly Munger, the millionaire behind the rival initiative, has even suggested she might start airing comparison ads arguing why voters should vote for her proposition, not Governor Brown's Prop. 30.

The mere presence of Ms. Munger's Proposition 38 could cause confusion among some voters, experts say. It could also draw some votes away from Prop. 30. And if both initiatives pass, only the one with more votes would be implemented.

At this point, Prop. 38 has only 34 percent support, according to a recent USC Dornsife/Los Angeles Times poll. But every vote could be precious for Prop. 30. And if Munger turns to "attack" ads, Prop. 30's passage could be in doubt.?

The Yes on 30 Coalition ? which includes top members of the California Teachers Association, the state Board of Education, and the state Senate ? sent a letter Monday to Munger calling on her to avoid negative attacks.

?Any actions to destroy Prop. 30 ? the one measure which would prevent $6 billion in cuts to schools and colleges and universities this year and which has a viable path to passage ? fly in the face of state goals to improve educational opportunities for our children,? says the letter.

Munger, who is the daughter of Charles Munger, a billionaire investor with Warren Buffet?s Berkshire Hathaway Corporation, has already spent $30 million of her own money. She says that Brown has exaggerated how much Prop. 30 would help education. "If you're going to say that you're something you're not, we do have to say, 'Well, actually, that's not the case,' " ?Munger told a local NBC affiliate on Sunday.

Brown?s plan would produce about $8.5 billion the first year and nearly $6.5 billion annually thereafter for state budgets by creating new income brackets for the state?s highest earners for seven years and upping the sales tax a quarter-cent. Munger's plan would provide close to $10 billion annually only for schools by increasing personal income taxes for a dozen years on all Californians, from less than 0.5 percentage points for the lowest earners to 2.2 percentage points for those making more than $2.5 million.

Undeterred by the letter, Munger spokesman Nathan Ballard said in a statement: "We really appreciate the campaign advice contained in the letter. However, we believe that voters are smart enough to make up their own minds between Prop. 30 and Prop. 38, and we will not shy away from making a comparison between the two measures because we believe Prop. 38 is far better for our schools than any other measure on the ballot."

Analysts say this 11th hour dogfight could sink both measures.

?If the Prop. 38 campaign attacks Prop. 30... expect the Prop. 30 campaign to counter,? says Michael Shires, professor of public policy at Pepperdine University. ?At that point, you could have two well-funded initiatives fighting it out, with the likely consequence they will both lose.?

Some analysts say the votes may come down to how personal wealth and ambition end up playing into decisions.

?This campaign is tight, and the Munger initiative is trending away from approval, but one open question is: Does that campaign take Prop. 30 down with it?? asks David McCuan, a political scientist at Sonoma State University. ?Is Munger more important to the future of education in California than Governor Brown??

Some analysts say it may be too late in the season to affect a change, because most advertising spots are already taken.

?The only ray of hope for Prop. 30 is that most of the ad buys are already done,? says Barbara O?Connor, director emeritus of the Institute for Study of Politics and Media at California State University, Sacramento, who says "governing California will be a nightmare? if Prop. 30 fails.

?Voters are very close to the point where more and more negative ads are just not going to have an impact," she adds. "They?re too saturated.?

Meningitis outbreak toll: 119 cases, 11 deaths

(AP) ? The number of people sickened by a deadly meningitis outbreak has now reached 119 cases, including 11 deaths.

The Centers for Disease Control and Prevention updated the count on Tuesday.

New Jersey is the 10th state to report at least one illness. The other states involved in the outbreak are Tennessee, Michigan, Virginia, Indiana, Florida, Maryland, Minnesota, North Carolina and Ohio.

Officials have tied the outbreak of rare fungal meningitis to steroid shots for back pain. The steroid was made by a specialty pharmacy in Massachusetts. At least one contaminated vial was found at the company.

The company recalled the steroid that was sent to clinics in 23 states, and later recalled everything it makes.

Confessions of a daredevil skydiver

Richard Ryan was the kind of kid who would drive a mom crazy ? dirt bike racing, motorcycles, you name it. If there was a thrill to be had in physical exploits, Ryan was in. But one domain, skydiving, was left unexplored until last year. "I never actually really wanted to skydive. I thought it was a bunch of crazy adrenaline junkies going out and cheating death every jump," he said.

Ryan, who turns 31 this week, has more than made up for lost time. With about 350 jumps under his belt, Ryan now earns a living as skydiver, specializing in HALO jumping ? high-altitude, low-opening ? which means jumping from an airplane flying as high as about 30,000 feet and delaying parachute opening as long as possible. In an interview with Discovery News correspondent Irene Klotz, Ryan explains why he does it. (Hint: It's not just the adrenaline.)

Discovery News: Is this your career or your passion or both?
Richard Ryan: A little of both, I guess. My (YouTube) channel takes elements of video games and movies and re-creates them in real life.

So you're the guy the TV commercials are thinking of when they air a stunt and say, "Do not try this at home."
Yea, I watch that and say, 'You know what? I think a lot of people would like to see me do that.' I've been quoted a lot of times saying, 'I live vicariously through myself.'

Skydiver Felix Baumgartner is about to attempt a jump from 120,000 feet, a new altitude record. Is he an icon in your community with his corporate sponsorship?
In all honesty, a jump like that just wouldn't happen unless you had a corporate sponsor. There are so many variables and so much that goes into a performance jump, or whatever you want to call it. Unless you're Richard Branson, you're really not going to have the funds to put into a project like that.

What's the difference between you and Felix, as far as how you jump?
There are so many different disciplines from traditional skydiving to belly flying where these groups work to make small and large formations, to fliers who go at faster speeds by skydiving standing up, sitting up or head down, to base jumpers who jump off cliffs, buildings, antennas and what not.

What's your highest jump?
29,500 feet

When you jump from that altitude, how much time do you spend falling?
It depends. When you're at a higher altitude, the air is thinner, so your fall rate is faster than it is when you're at 6,000 feet because the atmosphere is thicker, more resistant. Traditional skydives last 50 seconds to one minute from 12,500 feet. From about 30,000 feet if you're flying on your belly, it could last 2.5 minutes, something like that, until you're under canopy. If we do a wing suit jump, we could be in the air for four- to six minutes, depending on how we fly.

What's a wing suit?
It's a relatively new skydiving discipline. Physically, it's like squirrel suits. It's fabric ? a lot of the skydivers call them "prom dresses' ? that is essentially wings and a tail wing. Instead of falling straight to the Earth, you have a glide ratio. You can get a forward speed of 90 mph.

What do you think is the significance of Felix Baumgartner's jump this week, him trying to get that high and fall faster than the speed of sound?
The altitude is a great record to hold. For me, personally, I'm really excited to see him break the speed of sound in freefall. That just seems really, really cool to me. The reality is there are going to be so many more beneficial things that are going to come from it, all the medical instruments that they're monitoring him with. It means a lot for the next-generation spacesuits. Eventually something is going to come out of people having a good time that's actually going to save somebody's life down the road.

It sounds like the preparation for dives, especially for something as complicated as what Felix is going to do, is a big part of the project.
Yes, the engineers are constantly running scenarios, figuring out every situation and planning for it. I think being one step ahead is always better than finding out you have should invested a little more time in the R&D.

What first got you interested in skydiving?
It was the movie "Acts of Valor." Relativity Media asked me if I would be willing to re-create some elements from the movie to promote it. I never actually really wanted to skydive. I thought it was a bunch of crazy adrenaline junkies going out and cheating death every jump. I gave them a list of 10 different things that I wanted to do and they chose the HALO jump as one of the videos they wanted me to re-create. I had a few months to prepare. I went and did my accelerated freefall course and got into skydiving and soon found out that it's not necessarily the adrenaline-seeking junkies. It's a bunch of really good people with day jobs like lawyers, to grandmothers, to kids just out of high school. It's a very diverse community. It just completely flipped me and I've been hooked every since.

It's not the adrenaline?
Don't get me wrong, the adrenaline is definitely a plus. Adrenaline is one of the most addictive things I think you can have in your life. To be fair, my first seven jumps or so, it was all a very structured type of school. I was so focused on the work that I had to do that I never really had the time to just be on my belly and freefall and start panicking. By the time I was jumping on my own, I was very confident and comfortable, so it wasn't a panic adrenaline. It was a fun adrenaline.

Have you had your moment of panic?
No, not yet. I've had nothing but good luck so far. I've been fortunate that I've had a lot of really good instructors. We brief beforehand and they made sure that I was 100 percent confident in my ability and preparation, that I wasn't going to panic and that if something did happen that I knew what to do. That is a testimony to going to accredited schools and really taking the time to learn the safety.

Wouldn't a sense of self-preservation keep a person from jumping out of a plane?

We hear that a lot. I can honestly say that I am 100 percent confident that I would be willing to have someone I really love skydive. I would have no problem going to my local drop zone with the instructors I know and having my mom do a tandem jump with them. It's just so safe once you go through all the courses. Granted, accidents do happen, but I think a lot of that stuff gets taken out of context. You hear about base jumpers, which is an extremely high-risk sport, hitting a cliff or something. There's a lot of misconceptions.

Isn't fear of falling one of the most basic fears that people have?
Fear of falling is something a lot of people have. In all honesty, I have an issue with heights, but with the forward speed of the aircraft when you jump out you're falling down at what would be like sliding off of a hill. So it's not straight down. It's off at an angle, so you never actually get that feeling in your stomach or your throat that you're falling, because the wind is just all around you.

So, it's not like the roller coaster dead drop?
It's completely different. If you did a balloon jump or a base jump then yes, you'd get that dead air feel.

That's what Felix is going to have?
Yes. We jump in a different layer of the atmosphere. He is one of the only people who has ever jumped that high. He talks about when he jumped off the platform, he thought he was just suspended in air. He is falling at a certain speed, but the atmosphere is not as dense as it is at lower altitudes where he can feel the wind, so he thought he was just suspended in air.

So there's no frame of reference to gauge your fall?
Exactly. It'll be exciting to hear Felix talk about jumping from the altitude that he's at. Uncharted territory always is exciting, just finding out what the experience is like.

What would you say to the collective groan of mothers whose kids are going to be watching Felix's jump and say, "Wow that looks neat. I want to try it?'
I've been fortunate enough to have a mother who has always supported me in everything that I did. Maybe in part because she knew that I was going to do it anyway, so she wanted to make sure that she gave me her support and encouraged me to do it as safely as possible. I've always had that trust from my mom and I've always worked extra hard not to break that.

How many jumps have you done?
Around 350. I haven't even been skydiving for a year yet, and I've cranked out a lot.

How do you make a living doing this?
I look for any opportunity where I can do a product integration or sponsored video. You can't tell which ones are brand integration and which ones aren't. I never want to sell out to my audience, but I also want to get paid to do something.

So have you gotten your mom interested in jumping?
No, she wants to go paragliding. She thinks skydiving looks too dangerous. Paragliding looks more dangerous to me than skydiving. It's all perception.

Why do you do it?
Because I have no idea what to expect. I don't want to say it's an out-of-body experience when I do something like that, but it's not the Richard my mom or my girlfriend knows. It's that person pushing another person to do something that he normally wouldn't. That's why I say I live vicariously through myself. I really had to push myself to do it. I'm actually very much a homebody.

(AP) ? American companies should avoid sourcing network equipment from China's two leading technology firms because they pose a national security threat to the United States, the House Intelligence Committee warned Monday.

The panel said in a report that U.S. regulators should block mergers and acquisitions in this country by Huawei Technologies Ltd. and ZTE Corp, among the world's leading suppliers of telecommunications gear and mobile phones.

Reflecting U.S. concern over cyber-attacks traced to China, the report also recommends that U.S. government computer systems not include any components from the two firms because that could pose an espionage risk.

"China is known to be the major perpetrator of cyber-espionage, and Huawei and ZTE failed to alleviate serious concerns throughout this important investigation. American businesses should use other vendors," the committee's chairman, Rep. Mike Rogers, R-Mich, told a news conference. He said the Chinese companies could not be trusted with access to computer networks that support everything from power grids to finance systems.

The recommendations are the result of a yearlong probe, including a congressional hearing last month in which senior Chinese executives of both companies denied posing a security threat and being under Beijing's influence.

Rogers said they are clearly tied to the Chinese government, and that allowing Huawei and ZTE to provide network equipment and services in America risks confidential consumer information and undermines core national security interests. He said the committee was not concerned about the sales of handsets that make up the bulk of their U.S. businesses, but rather network infrastructure where they have made fewer inroads.

William Plummer, vice president for external affairs for Huawei, said his company, a private entity founded by a former Chinese military engineer, was being victimized because of U.S. government concerns about China's government.

"Huawei is Huawei, Huawei is not China," he told reporters. "My company should not be held hostage to someone's political agenda."

Ahead of the report's release, China's foreign ministry said investment by telecommunications companies is mutually beneficial. "We hope the U.S. will do more to benefit the interests of the two countries, not the opposite," spokesman Hong Lei said at a regular briefing in Beijing Monday.

The panel's recommendations, however, will likely hamper Huawei and ZTE's ambitions to expand their businesses in America. Their products are used in scores of countries, including in the West.

The bipartisan report could also become fodder for a presidential campaign in which the candidates have been competing in their readiness to clamp down on Chinese trade violations. Republican Mitt Romney, in particular, has made it a key point to get tougher on China by designating it a currency manipulator and fighting abuses such as intellectual property theft.

Rogers said its release had nothing to do with politics, and was motivated by the need to alert U.S. companies of the risks. The committee's top Democrat, C.A. Dutch Ruppersberger, said U.S. companies should proceed with "their eyes wide open." He cited an estimate from the U.S. Cyber Command that more than $300 billion in U.S. trade secrets was stolen last year.

The committee says it received information from industry experts and current and former Huawei employees suggesting that Huawei, in particular, may be violating U.S. laws. The allegations include immigration violations and an alleged "pattern and practice" of Huawei using pirated software in its U.S. facilities.

Rogers said that information of alleged bribery by Huawei to gain a contract in the U.S. would be forwarded Tuesday to the FBI, and he was confident it would lead to an investigation. The committee also planned to forward information on allegations of "beaconing" from Huawei equipment to China ? that is the unauthorized transfer of information from a computer network.

Huawei, founded in 1987 has grown rapidly to become the world's second largest supplier of telecommunications network gear, operating in more than 140 countries. ZTE Corp, which is partly state-owned, is the world's fourth largest mobile phone manufacturer, with 90,000 employees worldwide.

The report says the companies failed to provide responsive answers about their relationships and support by the Chinese government, and detailed information about their operations in the U.S. It says Huawei, in particular, failed to provide thorough information, including on its corporate structure, history, financial arrangements and management.

Plummer said it wasn't clear what Rogers was referring in the allegations of "beaconing." He said Huawei had provided "endless data" to the investigation, which he contended was not objective. He said its recommendations could create "market-distorting trade policy" and risk the tens of thousands of American jobs Huawei helps to support through procurement from U.S.-based suppliers that totaled $6.6 billion last year.

The recommendations "undermine competition, which undermines innovation which drives up the price of your broadband," he said.

ZTE said a Sept. 25 letter to the committee, released Monday, that China's government had never requested access to ZTE's equipment.

"Direct exclusion of one or two identifiable Chinese companies is an obvious unfair trade practice and, as a practical matter, would not provide meaningful security for US telecom infrastructure systems," the letter says.

In justifying its investigation, the committee contended that Chinese intelligence services, as well as private companies and other entities, often recruit those with direct access to corporate networks to steal trade secrets and other sensitive data.

It warned that malicious hardware or software implants in Chinese-manufactured telecommunications components and systems could allow Beijing to shut down or degrade critical national security systems in a time of a crisis.

Huawei denies being financed to undertake research and development for the Chinese military, but the committee says it has received internal Huawei documentation from former employees showing the company provides special network services to an entity alleged to be an elite cyber-warfare unit within the People's Liberation Army.

The intelligence committee recommended that the government's Committee on Foreign Investment in the United States, or CFIUS, bar mergers and acquisitions by both Huawei and ZTE. A multi-agency regulatory panel chaired by Treasury Secretary Timothy Geithner, CFIUS screens foreign investment proposals for potential national security threats.

Last year, Huawei had to unwind its purchase of a U.S. computer company, 3Leaf Systems, after it failed to win CFIUS approval. Still, Huawei employs 1,700 people in the U.S., and business is expanding. U.S. revenues rose to $1.3 billion in 2011, up from $765 million in 2010.

ZTE has also enjoyed growth in its sale of mobile devices, although in recent months it has faced allegations about banned sales of U.S.-sanctioned computer equipment to Iran. The FBI is probing reports that the company obstructed a U.S. government investigation into the sales.
