'Caged' Brings 'Toughest Fight' For Danger In Episode Four

Danger and Daniel tells MTV News why the new episode, which airs Monday at 10 p.m. ET, is one of their favorites.

We're only three episodes into MTV's new docu-series "Caged," and so far, the show has certainly packed a punch. With the fourth episode airing Monday at 10 p.m. ET, these amateur mixed martial arts fighters from the small town of Minden, Louisiana, are gearing up for some of their toughest competition yet, both in the cage and out.

MTV News caught up with Daniel and Matt a.k.a. Danger, who were visiting New York City for the first time, and they told us what fans can expect from this upcoming episode.

"For me, it's definitely my toughest fight for the season." Danger said. "I'm very excited for everybody to see it. ... Just fighting a really tough guy, really tough guy from a really tough camp. One of the higher-ranked guys in our state and in our area, so it's a fight I wanted for a long time and it finally came to fruition and it was a great fight. It didn't disappoint; I hope everybody enjoys it."

Fellow fighter Daniel said he's looking forward to fans getting to know his lighter side. He returned to the cage last week after suffering a knockout in the premiere episode and went on to win a tough fight on the anniversary of the tragic death of his girlfriend Hannah.

"I feel that my personality is going to finally start opening up a little bit more." Daniel said. "I'm obviously getting a little bit more used to the cameras and I just feel like you all get to see maybe a funnier side to me. Not just a robotic, deep-voiced guy that's always fighting for something crazy."

That's not all: On Monday night viewers will also be introduced to a new Minden fighter, who enters the cage for the first time.

"You'll get a chance to meet one of our boys, he makes his 'Caged' debut, John Wesley Reed," Danger revealed. "He's a great fighter, and everybody is going to fall in love with him too. So we're really excited about episode four; it's one of my favorites."

IGT Is Betting Online Big-Time (The Motley Fool)

Slot-machine maker International Game Technology (NYSE: IGT - News) looks poised to jump on the bandwagon of companies that are increasing their stake in online gaming. The company plans to acquire Double Down Interactive, one of the biggest virtual casino operators on Facebook.

What's it all about?
Under this deal, IGT will pay $250 million in cash and $85 million in retention payments over the next two years. Additionally, IGT will pay up to $165 million to Double Down, depending on the latter's performance in the next three years.

All in all, this looks like a large amount to pay for a company the size of Double Down, but it's not as if IGT can't afford it. IGT generated over $400 million in free cash flow over the last year.

So is the cash worth it?
This deal will certainly broaden IGT's scope of operations. Already a seller of gaming equipment to casinos, it will now be able to sell virtual products to virtual casinos as well. Being the third-largest social gaming application, Double Down may well provide IGT with a valuable foothold in casino-style social gaming.

Double Down has significantly increased its user count, to 4.7 million now from 3.3 million in October last year, as it capitalizes on the rapidly growing online gaming industry. The industry in itself is expected to grow to $30 billion in 2012 from $20 billion in 2010. What I do like about the deal, however, is the exposure to a new and complementary set of gamers, which is sure to drive IGT's fiscal 2012 earnings. But there's another, larger aspect to it.

What's the catch?
The Double Down deal would mean that IGT is investing around $100 for each one of the former's roughly 5 million users. Now that's a lot of money, something that can be justified only if we consider the potential big bucks IGT can earn if online gambling is legalized. In fact, legalization of online poker would be a dream come true for the casino and gaming industries, something that may be fast becoming a reality as the Justice Department considers doing away with the ban on online gambling.

However, IGT isn't alone. Facebook game maker Zynga (Nasdaq: ZNGA - News) has about 30 million players for its online poker game and could be a great partner for a big branded casino. Industry titan MGM (NYSE: MGM - News) has already partnered with Bwin.Party, and Boyd Gaming and is likely putting pressure on other operators to get a foothold in the space while they still can. IGT could be in for a lot of trouble if an operator inks a deal with Zynga.

Stakes in online gambling will be lower than those at real casinos. Nevertheless, the company's exposure to a widespread online audience should create abundant volumes to push up revenue. Looking at it from that aspect, $500 million doesn't seem particularly extravagant to me, after all.

The Foolish bottom line
This deal could very well be IGT's royal flush. The company seems to be banking on potential revenue based on the expectations that online poker will be legalized. Till then, let's keep our fingers crossed on this one.

Water leaks found at stricken Japan nuclear plant

Japan's stricken nuclear power plant has leaked more than 160 gallons of water, forcing it to briefly suspend cooling operations at a spent-fuel pond at the weekend, the plant's operator and domestic media said.

The Fukushima plant, on the coast north of Tokyo, was wrecked by a huge earthquake and tsunami in March last year, triggering the evacuation of around 80,000 people in the world's worst nuclear crisis in 25 years.

The operator of the complex, the Tokyo Electric Power Co (Tepco), reported two main leakages on its website on Sunday, one from a pump near the plant's office building and another from a back-up cooling system at reactor No.4.

"The cooling water is from a filtrate tank for fire extinction and doesn't contain radioactive materials," Tepco said of the incident at reactor No. 4. It added that some water from the other leakage had flowed into a drain and "we are examining whether this water has flowed into the ocean or not."

The Nikkei newspaper Monday quoted Tepco as saying around 40 liters (10.6 gallons) had leaked from the pool-cooling system of the No. 4 reactor Sunday morning, with probably 600 liters (158.5 gallons) of purified water leaking from another point. Water had also leaked at other facilities within the complex, the Nikkei added.

However, the Nikkei newspaper quoted Tepco Monday as saying that it believed no water had escaped into the sea.

"The leakage is believed to have been caused by freezing due to cold weather, and the leaked water included radioactively contaminated water that has been purified," the Nikkei said in its online edition, quoting Tepco. "The contamination level is low."

Meanwhile, Japan's deputy prime minister has acknowledged that the government failed to take minutes of 10 meetings last year on the response to the country's disasters and nuclear crisis and called for officials to compile reports on the meetings retroactively.

The missing minutes have become a hot political debate, with opposition lawmakers saying they are necessary to provide a transparent record of the government's discussion after the March 11 earthquake and tsunami touched off the worst nuclear accident since Chernobyl in 1986.

Deputy Prime Minister Katsuya Okada confirmed Friday that the minutes were not fully recorded at the time and called for them to be written up, retroactively, by the end of February. Three of the meetings during the chaotic period had no record at all, not even an agenda, including a government nuclear crisis meeting headed by the prime minister.

Okada has set up a panel to investigate the extent of the problem and its cause.

The missing minutes are the latest example of the government missteps in disclosing information.

Japanese authorities and regulators already have been repeatedly criticized for how they handled information amid the unfolding nuclear crisis. Officials initially denied that the reactors had melted down, and have been accused of playing down the health risks of exposure to radiation.

The government also kept secret a worst-case scenario that tens of millions of people, including Tokyo residents, might need to leave their homes, according to a report obtained recently by The Associated Press.

In recent days, Obama released an ad blasting ?secretive oil billionaires? for attacks on him, Nancy Pelosi unveiled a campaign slogan, calling for ?a new politics free of special interest influence,? and the Democratic National Committee released a Web ad accusing Mitt Romney of lying about his ties to a super PAC that?s spent millions supporting him.

Maybe that would have sounded better in 2008, when Obama put the kibosh on the Democratic outside money infrastructure ? or even in 2010, when Obama led a chorus of Democrats assailing Republicans? outside spending.

But this year, Democrats are playing the same game. Obama?s team has blessed a network of super PACs trying to raise the same seven-figure checks as Romney?s. And Obama?s allies have gone even further than Romney?s, setting up nonprofit groups that do not disclose their donors at all.

In fact, top Democrats are so adament about the need to raise unlimited ? and sometimes secret ? cash this year that some operatives aren?t pleased about the recent attacks. It?s a whole lot tougher to get wealthy liberals to fork over mega-checks when the politicians who?d benefit are ripping Republicans for taking the same types of contributions.

Then there are doubts about the effectiveness of such attacks, considering how they went the last time Democrats tried them in 2010. Obama and his allies spent the final weeks before Election Day complaining bitterly about GOP-allied spending groups, hinting they could be awash in illegal foreign money, only to watch Republicans notch historic gains in the House.

And, beyond that, the Obama campaign?s juggernaut fundraising makes the president an especially poor messenger for the attacks, reasoned one Democratic operative familiar with the party?s outside money operation.

?When you?ve been talking about raising $1 billion, you really shouldn?t be talking about money in the political process,? the operative said. Democrats ?should talk about issues that people really care about like whether their taxes are going to get raised, whether their kid is going to get sent to Afghanistan, or whether they?re going to get blown up on a plane,? the operative said, adding ?campaign finance isn?t a particularly resonate issue other than for those who are talking about it.?

But party leaders suggest the secret money attacks forecast in Obama?s ad ? his first of the cycle ? are part of a broader messaging strategy that seeks to cast Republicans as secretive and unethical pawns of big business who couldn?t care less about the plight of regular Americans.

?The reason that it was something we led with was that it?s part of the contrast,? said DNC Chairman Debbie Wasserman Schultz when asked about why Obama?s ad began with a secret money attack rather than the gauzy positive themes that typically define inaugural ads.

The theme seems geared partly toward a potential general election that pits Obama against Romney ? the GOP presidential candidate Democrats would least like to face. The former Massachusetts governor has come under heavy Democratic fire in recent days for his reluctance to detail his work at the helm of the private equity firm Bain Capital and his refusal to release his campaign bundlers or multiple years of tax returns ? disclosures that Obama has made.

And, without prompting, Wasserman Schultz, a Florida congresswoman, pointed to Romney to explain the theme behind Obama?s ad. ?It?s a pattern. Just look at Mitt Romney. He isn?t being frank and honest about his role in Bain Capital. He accepts hundreds of millions of dollars in shadowy special interest money that he talks out of both sides of his face about,? the Florida congresswoman told POLITICO, referring to Romney?s struggles to define his relationship with the deep-pocketed super PAC, Restore Our Future, which has buoyed his campaign with sharp ads savaging his opponents.

GORHAM, Maine (AP) ? Ron Paul said Saturday the Republican presidential race has "a ways to go" and he doesn't intend to get out or get behind another candidate anytime soon.

The Texas congressman was campaigning Saturday in Maine, which holds caucuses beginning Feb. 4. He spoke to an overflow crowd at the University of Southern Maine and held an outdoor rally outside the famed L.L. Bean store in Freeport. He picked up the endorsement of Linda Bean, the granddaughter of the Bean company founder and a prominent Republican activist in the state.

Paul told reporters that it didn't make sense for him to campaign in Florida, which holds its primary Tuesday and awards all its 50 delegates to the winner. Polling indicates Mitt Romney is leading the field there.

"Some other campaigns have many, many millions of dollars to run a campaign," Paul said. "We maximize the delegates the way we're doing it."

Paul planned to campaign next week in other caucus states, including Nevada, which also holds its caucus on Feb. 4, and Colorado and Minnesota, which hold caucuses Feb. 7.

Paul dismissed suggestions he would back any of his GOP rivals.

"I think that's premature. We have a ways to go," Paul said, adding he was glad they were speaking favorably about some of his libertarian-leaning views.

"I'll work with anybody who wants to come in the direction of Constitutional government," Paul said.

He noted that Newt Gingrich had endorsed his views on monetary policy in a nationally televised debate this week. Paul has called for the Federal Reserve to be audited and ultimately eliminated, and wants the value of the dollar tied to gold.

Paul said he hoped the former House speaker and others would also adopt his noninterventionist foreign policy views, which are far outside the Republican Party mainstream.

"If he says 'I agree with Ron Paul, we should bring the troops home from Afghanistan,' my ears would pop up," Paul said.

Australia close to 4-0 sweep of India

Adelaide Oval's former groundsman Nathan Lyon took his dream wicket by dismissing India's Sachin Tendulkar on Friday as Australia edged closer to a 4-0 series sweep.

India will resume on Saturday's final day of the fourth Test on 6-166 after the home side set the tourists a world-record target of 500 to win.

Lyon, playing his first Test on his home ground, has taken 3-57 in India's second innings in his best haul of the series.

The 24-year-old offspinner claimed the big scalps of Virender Sehwag (62), VVS Laxman (35) and Tendulkar (13).

Laxman fell in the third-last over of the day as Shaun Marsh took a sharp catch at mid-wicket.

In the following over, Ben Hilfenhaus showed his athleticism to run out Virat Kohli for 22. The pair had exchanged angry words during India's first innings when Kohli scored his maiden hundred.

Wriddhiman Saha is yet to score and Ishant Sharma is two not out.

Kohli had complained in his press conference on Thursday that Hilfenhaus had sledged him with an unnecessary comment "out of the blue".

"What's been said on the field stays on the field as far as I'm concerned. Ben Hilfenhaus's run out was pretty special," Lyon said.

Perhaps only rain can save India, with possible showers forecast for Saturday.

Earlier, Gautam Gambhir was caught behind off Ryan Harris for three before fellow opener Sehwag blasted a half-century off 36 balls.

The Delhi thrasher took a huge swipe at a full toss from Lyon and top-edged a catch to cover.

Rahul Dravid (25) was caught at gully off Harris.

In a key breakthrough, Test cricket's leading runscorer Tendulkar was caught at short leg.

The 38-year-old, set to become the first player to score 100 international centuries since notching his 99th ton in March 2011, was given a standing ovation by the crowd of 17,408.

"It has been an absolute privilege to get him out," Lyon said.

Lyon admitted the delivery to remove Sehwag was not one of his best.

"I'm not going to call him back, that's for sure," he said.

Lyon had taken 2-180 in the first two Tests and the spinner was dropped for the third Test on the bouncy Perth pitch.

But the crafty 10-Test spinner has taken 1-48 and 3-57 in a solid effort in Adelaide.

"It's just good to be able to contribute to hopefully a team victory," added Lyon, who was a groundsman at Adelaide Oval last summer.

"I'm enjoying the Test match rather than sitting on the roller watching it," he said.

"It has been a fantastic experience playing in front of the home crowd and I've really enjoyed every moment of it."

Australia declared their second innings closed three overs after lunch at 5-167 with Ricky Ponting unbeaten on 60 and Brad Haddin 11 not out.

Skipper Michael Clarke contributed 37 and Mike Hussey made 15.

Spinner Ravi Ashwin, who took five wickets in the match, said there were no excuses for the second-ranked India's likely run of eight consecutive Test defeats in England and Australia.

"A team that wants to count themselves to be on top of the world has to really perform all over the place," he said.

Spotify tops three million paying subscribers, 20 percent of its active user base

It hit two million paying subscribers in September of last year and 2.5 million in November, and now Spotify has hit another big milestone. According to the Financial Times, it now has three million subscribers paying for one of its premium services, which reportedly represents more than 20 percent of its active user base. As the FT notes, that percentage is up from 15 percent in March of last year, and Spotify says that its "active" users don't include folks who signed up for a a free trial of its premium service but didn't continue to use the free service. Interestingly, the company also revealed that over half of its paying subscribers are under 30, which Spotify's Ken Parks says is a "remarkable number of people who are generally hard to monetize."

EU still sees chance for Israel-Palestinian talks (AP)

AMMAN, Jordan ? A low-level dialogue between Israelis and Palestinians is not at a dead end, the European Union's foreign policy chief said Thursday, hoping that contacts to get "real negotiations under way" will continue.

"I don't think there's an impasse," Ashton told reporters following talks with Palestinian President Mahmoud Abbas in the Jordanian capital.

Her remarks come a day after Abbas said informal talks between Israelis and Palestinians about the border of a future Palestinian state ended without any breakthrough.

"President Abbas is thinking carefully about how to move forward," Ashton said. Abbas has said he will consult on his next moves with the Arab League in a meeting planned for Feb. 4 in Cairo.

While frustrated with the lack of progress, Abbas is under pressure to extend the Jordan-hosted exploratory talks, which the international community hopes will lead to a resumption of long-stalled formal negotiations on establishing an independent Palestinian state.

The Arab League consultation stage could leave the door open to continue the low-level meetings.

A Palestinian walkout could cost Abbas international sympathy at a time when he seeks global recognition of a state of Palestine in the West Bank, Gaza and east Jerusalem, territories Israel captured in the 1967 Mideast war.

The border issue is at the heart of the current standoff. The Palestinians want Israel to halt construction in settlements in the territories they claim, along with an Israeli commitment to make the pre-1967 war lines the basis of a future agreement.

In Jerusalem, Israeli officials said they hoped Abbas would not end the talks. An official familiar with the negotiations said that during Wednesday night's meeting, the Israelis gave their "principles" for setting a border.

"We presented the Palestinian side the central points that determine our policy on dealing with the territorial issue," the official said, speaking on condition of anonymity because he was discussing sensitive negotiations.

He refused to elaborate on what was presented, or even to term it a proposal. He said the Palestinians had requested "clarifications on a number of issues," and Israel had also asked for clarifications on some Palestinian proposals presented so far.

The official said the Israelis believe it's "very important" to continue the newly resumed talks, with the goal of forging a comprehensive peace this year.

Israeli Prime Minister Benjamin Netanyahu rules out a return to the pre-1967 war lines. He opposes any withdrawal from east Jerusalem and has signaled that he wants to retain an Israeli presence in key parts of the West Bank. Palestinians reject those positions.

Israel withdrew from Gaza, the other part of the state the Palestinians seek, in 2005.

After meeting with Abbas and Israelis in the past few days, Ashton said, "I still remain hopeful that with goodwill, they can continue to talk."

Under Jordanian mediation, Israeli and Palestinian envoys have met several times over the past month. The Quartet of international mediators ? the U.S., the U.N., the EU and Russia ? said last fall that it expected both sides to submit detailed proposals on borders and security arrangements in these meetings.

The Palestinians say that Thursday is a deadline for the proposals, while Israel says it is only in April. Ashton said the deadline was not "written in stone, but was there to give a sense of dynamic or momentum."

Engineered bacteria effectively target tumors, enabling tumor imaging potential in mice

ScienceDaily (Jan. 25, 2012) ? Tumor-targeted bioluminescent bacteria have been shown for the first time to provide accurate 3-D images of tumors in mice, further advancing the potential for targeted cancer drug delivery, according to a study published in the Jan. 25 issue of the online journal PLoS ONE.

The specially engineered probiotic bacteria, like those found in many yogurts, were intravenously injected into mice with tumors, after which the researchers took full body bioluminescent images. The 3-D images revealed information about the number and location of the bacteria, to the level of precisely revealing where within the tumor the bacteria were living, providing much more information on the interaction of bacteria and tumors than was previously available using similar two-dimensional imaging methods.

According to the authors, led by Mark Tangney of University College Cork in Ireland, "before now, researchers used luminescence to provide an approximation of where a test organism was within the body, and would then follow up with multiple further experiments using different techniques to try to find a precise location."

This new research suggests that such bacteria can be engineered to contain diagnostic or therapeutic agents that would be produced specifically within the tumor for targeted treatment.

Sony ST25i 'Kumquat' looks set to launch as 'Xperia U'

We got our first glimpse of the Sony ST25i "Kumquat" last week, and now it seems we may have the official name for the device, too. According to a new entry on the website of the Indonesian telecoms authority, the phone will launch as the Sony Xperia U. This continuing the lettered naming scheme used by the Xperia S, as well as last year's Tablet S and Tablet P.

The ST25i "Xperia U" is rumored to sport a 3.5-inch qHD (960x540) screen, a 1GHz dual-core CPU and 5MP camera, making for an attractive mid-range proposition. An unofficial, leaked roadmap lists the Xperia U around the €260 price point.

As Sony expands its 2012 line-up, we're looking forward to seeing more of the Xperia U, hopefully starting with an official introduction at Mobile World Congress next month.

Liam Neeson used to be in fancy-pants movies like Schindler's List and Nell and Rob Roy ... I mean, in 1993's Ethan Frome, he played Ethan Frome.

At some point, though, he got really into beating people up. In 2008, he had a huge hit with Taken, where he beats people up because they kidnapped his daughter. In Clash Of The Titans, he vicariously beat people up by releasing the Kraken. (Not a euphemism.) Then his desire for action became such that he actually joined The A Team! (You probably didn't see that one.) Last year in Unknown, he beat up everyone who didn't recognize him. (Which was everyone.) In the upcoming Battleship, if I am understanding the premise, he's going to fight aliens with boats.

And this Friday, in The Grey? Wolves. That's right. Liam Neeson is fighting wolves. And I'll be darned if, at the end of this trailer, it doesn't look like he's strapping on some improvised claws to punch a freaking wolf.

This naturally raises the question: After you've punched a wolf and released the Kraken, what is left to punch? Thank goodness we have suggestions, for satisfying plots or great movies or, of course, both.

Cats. In Claws, Neeson plays a former FBI agent who breaks up a ring of illicit mouse trafficking, only to find that the perpetrators are highly trained Siamese cats. Fighting ensues.

Bankers. In Foreclosure, Neeson plays a college professor whose house is being foreclosed on by the ominous, much hated bank that recently took over his small town's only financial institution. He goes to the institution's headquarters to get some answers. Fighting ensues.

Adam Carolla. In Funny Man, Neeson plays a father of five whose wife runs off with a comedian played by Carolla who turns out to be up to no good and secretly plotting to kill her for her life insurance money. Fighting ensues.

Ice dancers. In Spin, Neeson plays a grieving widower whose only son has run off to join an ice show, which he learns is a front for a dangerous cult. He goes on the road to bring his son home. Fighting ensues.

Best Buy television salespeople. In Warranty, Neeson plays a down-on-his-luck real estate agent who wants to buy a television for his ailing wife, Greta. But when he arrives at the store, he's told that the store is out of the model they advertised on sale, and he has to figure out how to get an expensive plasma model out of the store in time for Greta to watch Downton Abbey. Fighting ensues.

Baristas. In Venti, Neeson plays an artisanal fair-trade coffee roaster who learns that a major coffee shop chain is going to stop carrying his beans and switch to a mass-produced brand. He goes to one of the franchise locations to talk to the customers and plead his case, but he's told he has to leave, and eventually, a misunderstanding leads to false reports that he's holding the store hostage. Fighting ensues.

Maggie Smith. The title: Dowager. The spoiler alert: Maggie Smith wins. Fighting is concluded.

Steven Seagal. In The Ponytail, Neeson plays a high-school principal who learns that a former action-movie star is planning to rob his school during an assembly. Only the principal can stop the siege and protect the school's educational booty. Fighting ensues.

Aquaman. In Sea Floor, a submarine commander is surprised to learn that he's sharing his domain with an intruder he's always assumed to be mythical. But that's not the case, and it's going to be every man for himself as they battle for control. Fighting ensues.

More wolves. However many wolves there are in this movie? More wolves in the next movie. FIGHTING ENSUES.

How to Register Your New Business Name

You?ve brainstormed, polled your family and friends and conducted some kind of focus group testing. You?ve come up with a cool domain name. Finally, you?ve crossed one of the trickiest hurdles for any new business ? finding the right name for your new brand.

But not so fast. Before you unleash your name on the world, you?ve got to dot a few administrative ?i?s? and cross a few legal ?t?s.? There are three key legal steps in the naming process.

  • Make sure the name is available.
  • Register the name with your state.
  • Register your property (a.k.a. the name) with the federal government.

Keep in mind that trademark law is complex. While this is a brief introduction to the steps involved, there are specific situations that may vary.

1. Make Sure the Name Is Available to Use


Before you start ordering letterhead and marketing material, you need to make sure your name is available in the state where you are planning to conduct business, and also nationwide. No one wants to find themselves on the wrong end of a trademark dispute. First, there could be punitive damages and legal fees to pay. And even more costly, you could be ordered to rename your company immediately ? putting you back at square one in terms of brand recognition.

  • Before you incorporate or register your business with your state, check the state?s database of company names.
  • At this point, you should also conduct a free trademark search to check if your business name is available to use at the federal level. The U.S. Patent and Trademark Office (USPTO) offers a free search tool to see if your name is available to use nationwide.
  • It?s also important to know that you can still infringe upon someone else?s mark even if they?ve never formally registered it with the USPTO. For this reason, you?ll also need to do a comprehensive nationwide trademark search into state and local databases (beyond just your own state). This should include common law and county registrars. You can find affordable online services to simplify this task for you by performing a comprehensive search into state and local databases.

2. Register the Name With Your State


When you incorporate or form an LLC for your new business, the name is registered with your state?s secretary of state. Before approving your application, the secretary of state?s office checks that your name is distinguishable from all other business names registered in the state (just in case you didn?t search yourself in step one). Once approved, the business name is yours, and yours alone, to use within the state. This act protects anyone else from using your name within your state, but it doesn?t offer any kind of protection in the other 49 states.

If you?re not planning on incorporating or forming an LLC, you can still register a business name using a DBA (Doing Business As), which is also known as a Fictitious Business Name. It?s the easiest type of registration, and can be completed through your county government offices.

If you?ve started a business that?s physically tied to your state ? such as a hair salon or a restaurant ? and have no plans to expand into other states, registering your name with the state or county might be enough brand protection for you. However, if you?re planning to conduct business outside your own state (i.e. you sell a product or provide services to clients who live elsewhere), you should look into trademark protection.


3. Register a Trademark with the Federal Government


You?re not actually required by law to register a trademark. Use of a name instantly gives you common law rights as an owner, even without formal registration. However, as mentioned above, trademark law is complex. Simply registering a DBA in your state doesn?t automatically grant you common law rights; in order to claim first use, the name has to be ?trademarkable? and in use in commerce.

Registering a trademark offers a few advantages:

  • Trademarks registered with the USPTO enjoy significantly stronger protection than ?common law? marks, or unregistered marks. When you register a trademark, it?s exponentially easier for you to recover your properties ? for example, if someone happens to be using a close variation of your domain name or is using your company name as their Twitter handle.
  • A trademark is property ? it has value and can be sold as a corporate asset.

To register your business name, you?ll need to file an application with the USPTO. Expect to pay approximately $325 per class in application fees that your mark would fall under. Once you submit your application, the process can take anywhere from 6-12 months, so it?s smart to perform a comprehensive trademark search before starting the application process. If your selected name is not available, your application will be rejected. You?ll lose your application fee, not to mention any time invested in the application.

While the process of registering a trademark is more involved than registering a DBA, rights to your name will be enforced by both the federal and state governments.


Take the Right Steps


As you?re getting your company off the ground, make sure to take brand protection seriously. You?ve spent untold hours deliberating the ideal name, and you?ll be spending even more time cultivating brand recognition. Your name represents your brand and business, so take the right steps up front to protect your identity.

Drought returns to Sahel, bringing hunger (AP)

DAKAR, Senegal ? For the third time in the past decade, drought has returned to the arid, western shoulder of Africa, bringing hunger to millions. Aid agencies are warning that if action is not taken now, the region known as the Sahel could slip into crisis.

More than 1 million children in the eight affected countries are expected to face life-threatening malnutrition this year, according to the United Nations Children's Fund. The region has not yet recovered from the last drought two years ago, and many families lost their herds which means that they will not have assets to purchase food.

Aid workers also worry that donors are suffering from "famine fatigue," as the looming West African crisis comes just six months after Somalia's capital was declared a famine zone.

"I think there is a real risk that people may think this is the kind of thing that just happens every few years," Stephen Cockburn, the West Africa regional campaign manager for Oxfam, said of the droughts in the Sahel.

Earlier this week, aid agencies revealed that thousands of people died needlessly in the Horn of Africa because donors waited until people started dying to respond. The warning signs were there as early as August 2010 but aid wasn't ramped up until July 2011.

Signs of the looming famine in the Sahel were first detected late last year, according to the report released Wednesday by Oxfam and Save the Children. The lessons of Somalia and the Horn of Africa, where as many as 100,000 people died, are front and center in how aid agencies are responding to the potential famine in West Africa.

"Everyone recognizes in looking back that there was a delay in responding (in the Horn of Africa). Tens of thousands of people died because of that delay ... We know from this recent and painful experience what the risks are," said Cockburn.

He said that there could be more hope for the Sahel, since the indications of a crisis have been detected early on.

"The alarms (for the Sahel) were already sounding in November and December. Every country in the region, and every president in the region, has recognized this and asked for outside help," he said.

The U.N. children's agency was among the agencies reacting early. The organization issued an appeal in December and began ordering therapeutic foods for infants and toddlers. By then, Niger had already issued its own alert saying that more than half the country's villages were vulnerable to food insecurity.

Droughts in the Sahel ? a region spanning eight countries, including northern Senegal, Mauritania, Mali, Niger, Burkina Faso, northern Nigeria, Cameroon and southern Chad ? have become increasingly frequent with emergencies declared in 2005, 2008 and 2010. The consequences are especially dire for children, said UNICEF spokesman Martin Dawes.

"In this crisis adults will suffer, but children will die. Why? Because nutrition deterioration is a vicious cycle ? in growing, the body requires more to replace and make up what it lacks and when the right kinds of food are not available the situation gets worse," said Dawes. "They go from moderately malnourished to acute, and lifesaving intervention is needed."

As the child gets weaker, he or she becomes more vulnerable to routine problems, like diarrhea. The child is less able to fend off diseases, and the effects are more pronounced, Dawes said.

Even during a non-drought year, as many as 300,000 children die of malnutrition in the Sahel, says Cockburn. It's a region that is perpetually on the edge, and any extra shock sends it over the precipice.

"The increasing frequency of droughts in the Sahel means that communities have had little time to recover from the last food crisis," according to Malek Triki, the Dakar-based spokesman for the U.N. World Food Program. "Their savings are exhausted and livestock herds have not been rebuilt."

The United Nations is already purchasing food and deploying specialized teams to the region. Grain prices across the region are rising and WFP has observed a rush on maize by wholesalers, who are buying up local stocks. Markets are emptying and staples including millet and sorghum are now in short supply.

Traders from the Sahel are traveling increasingly greater distances to buy maize, with some spotted as far as northern Ivory Coast, according to the WFP.

Cockburn said that the hard-learned lessons of Somalia are already bearing fruit. He is cautiously optimistic by the response from the European Union, which announced this week that it is doubling its humanitarian aid for the Sahel.

Kristalina Georgieva, the European commissioner for humanitarian aid visited Niger on Wednesday in order to see the problem up close.

"Within months people will begin to starve unless we act," she said, according to a statement posted on the European Union's website. "The alarm bells are ringing."

(AP) ? The president of Madagascar, exiled in South Africa since a 2009 coup, said Friday he will return to his Indian Ocean homeland on Saturday even though he faces arrest there.

Following the coup, Marc Ravalomanana was convicted in absentia of conspiracy to commit murder in a case related to the turmoil during his overthrow. The court was appointed by Andry Rajoelina, who took power with the military's backing in 2009. Ravalomanana called the tribunal illegitimate.

"Any attempt to arrest me will be unlawful," Ravalomanana told reporters Friday. "I have not committed any of the crimes of which I am accused by the illegal regime."

Harry Laurent Rahajason, the government spokesman in Madagascar, said Ravalomanana "will be arrested" if he returns.

Attempts to find a political solution in Madagascar have been troubled. A new prime minister and unity Cabinet that took office last year were greeted with protests by some opposition figures and skepticism from the international community. Rajoelina appears firmly in control.

Kodak files for Chapter 11 bankruptcy (Yahoo! News)

Yet another classic camera manufacturer was unable to stay afloat in a digital age

A sad day for lovers of classic?photography: Famed camera and film manufacturer Kodak has officially filed today for?Chapter 11 bankruptcy. According to the filing,?Kodak owes about $6.75 billion in debt and has just over $5 billion in assets.

The company isn't folding completely, per se ? Chapter 11 bankruptcy is a reorganization process designed to stave off shuttering the company. Many companies have been able to successfully come out of Chapter 11, such as clothing retailer Macy's.?To provide information to Kodak customers and debtors, a website has been launched to provide more information about the restructuring process at?www.kodaktransforms.com.

The company has struggled in recent decades. It lost a?court battle to Polaroid in the 1980s, forcing Kodak out of the instant camera business. Of course, neither Kodak nor Polaroid were able to develop the following in the digital camera market needed for either company to stay afloat.?Polaroid filed for Chapter 11 bankruptcy in 2001. It's assets were sold at auction, leaving stockholders with nothing and employees out of work.

Japan's Fujifilm calls for Swiss-style yen (Reuters)

TOKYO (Reuters) ? Fujifilm Holdings President Shigetaka Komori wants a Swiss-style cap on the yen to help Japanese firms, he said in an interview on Wednesday, adding his voice to a growing chorus of executives including Nissan's Carlos Ghosn.

Komori also said diversification helped protect Fujifilm from meeting the same fate as photographic film pioneer Eastman Kodak, which is preparing a Chapter 11 bankruptcy filing in case it is unable to sell its digital patents to raise capital, a report said earlier this month.

Fujifilm, which diversified from the shriveling photographic film market into digital photography, printers and healthcare, in October cut its operating profit forecast for the financial year ending in March by 15 percent to 136.5 billion yen ($1.8 billion), blaming the strong yen and global economic uncertainty.

But Komori said that would amount to a record profit if calculated on the basis of 2007 exchange rates and materials prices.

"The government is showing weak leadership," he said. "We are asking the government to do something like Switzerland," Komori said, referring to the Swiss National Bank's cap on the franc at 1.20 per euro, introduced last September.

Japanese Finance Minister Jun Azumi, however, told reporters on Wednesday that it would be hard for Japan to set such an upper limit on its currency given the vast supply of yen in global markets.

"From the standpoint that the Japanese yen is basically the third key currency after the dollar and the euro, we cannot go as far as the Swiss have done," Azumi said.

Fujifilm's Komori sees 90 yen to the dollar as a fair exchange rate, compared with current rates of about 77 yen.

But he said Fujifilm could bear the current rates and that he currently had no plans to shift more production overseas.

Nissan's Ghosn said last November many projects were being moved outside Japan because businesses could not cope with current exchange rates. He called for a fixed exchange rate.

Komori lamented the fate of Kodak, with which it is currently engaged in a court battle over digital camera patents, as the U.S. firm also tries to sell its patent portfolio to secure enough funds to enable it to avoid bankruptcy.

"It's a shame. They used to be a strong rival," he said. "Kodak were not as well prepared as us for the digital era," he added.

Failure to develop a wide portfolio of businesses may also have weakened the U.S. company, whose name was once synonymous with photography, Komori said.

"Kodak said they just wanted to be a digital company. But that alone was not enough," he said, noting that Fujifilm has expanded into pharmaceuticals, medical and office equipment as well as films used in liquid-crystal display panels.

Windows Phone overtakes Apple iOS by 2015?

Nokia is not only pinning its hopes for renewed relevancy with its first 4G LTE Windows Phone, the Lumia 900, it could also break the smartphone operating system deadlock and propel Windows Phone ahead of iOS.

Market researchers at IHS have published a report that predicts the usurping of Apple's iOS by Windows Phone in 2015 by a slight margin, leaving Android with a more-than-comfortable lead at No.1.

(This, despite a recent Nielsen survey that shows Apple closing in on Android, with more smartphone buyers choosing iOS in recent purchases.)?

IHS reports that in three years, "Windows Phone will account for 16.7 percent of the smartphones shipped, up from less than 2 percent in 2011."

Wayne Lam, who wrote the IHS release, is a fan of the new phone, and sees it as the key toward turning things around for Nokia.

"This hot product represents Nokia's first step to reclaim its market share. Combined with Nokia's efforts to drive the development of the Windows Phone ecosystem, the Lumia 900 and its successors will help Microsoft to reclaim its No. 2 ranking in smartphone operating system market share in 2015."

It's an attractive device that Nokia debuted at the recent Consumer Electronics Show in Las Vegas. In a diminutive frame, the phone has a?4.3-inch AMOLED touch screen, a 12-megapixel camera with Carl Zeiss optics (an F2.2 aperture lens with a 28mm focal length) and front-facing camera for video chats and a?long-lasting 1830 mAH battery.

As with other Windows Phones, it features the "People Hub," which connects the phone's owner with friends in real-time updates with "Live Tiles." Nokia has partnered with major carriers in North America, including?Rogers and Telus; and in the U.S., AT&T.

Lam sees the Lumia 900 as an almost messianic device to trigger Nokia's dominance within the Windows Phone arena, too:

Although Nokia is not the only seller of Windows Phone smartphones, the company is expected to dominate the market, accounting for 50 percent of all Microsoft OS-based handsets sold in 2012, IHS predicts. The company?s share then is set to rise to 62 percent in 2013. Nokia's portion of the market will begin to decline in 2014, as other companies increase their sales of Windows Phone products.

Nokia is also hoping to make inroads with the new-to-the-smartphone crowd through T-Mobile and its Lumia 710 ??which I'm not yet convinced is right for first-timers like my dad, who have never touched a touch screen before, much less a smartphone, but I am willing to spend more time with it (so you'll read about that in due time, Windows Phone fanboys). That phone has been priced to sell to the masses, costing nothing at Walmart (with a two-year contract) and only a penny at Costco.
